These Terms of Service (the “Terms”) govern your use of the website, online store, products, and related services operated under the name matcha stillness (collectively, the “Services”) by Stillness Lab LLC (“we,” “us,” or “our”).

By browsing or using the Services or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree to these Terms, please do not use the Services.

1. Use of the Services

You must be of an age at which you are legally able to enter into a contract in your country or region of residence. If a minor uses the Services, the minor must have the consent of a parent or legal guardian.

When using the Services, you agree to provide accurate, complete, and current information. You must not provide false or inaccurate information or use another person’s information without authorization.

2. Account Management

If you create an account, you are responsible for securely managing your login information and password. You must not transfer, lend, sell, or share your account with another person.

We make reasonable efforts to accurately display product names, descriptions, images, prices, ingredients, net contents, storage instructions, and other product information. However, the color or appearance of a product may differ from what you see on your screen due to your device, display settings, lighting, or other conditions.

Product packaging, design, specifications, and other details may change without notice due to quality improvements, legal requirements, manufacturing circumstances, or other reasonable reasons.

We may limit product quantities, restrict the countries or regions where products are available, or discontinue products at any time.

4. Important Information About Food Products

Before purchasing or consuming a food product, please review the ingredients, allergen information, storage instructions, best-before date, and directions shown on the product page and product packaging.

If you have a food allergy, medical condition, take medication, or have other health concerns, please consult an appropriate healthcare professional when necessary and use the product at your own discretion.

Information provided through the Services is not intended to replace diagnosis, treatment, or medical advice from a physician or other qualified professional.

5. Orders and Formation of the Sales Contract

When you submit an order, you make an offer to purchase the selected products. A sales contract is formed when we accept your order and send you an order confirmation email.

We may decline or cancel an order for reasonable reasons, including insufficient inventory, errors in product information or pricing, payment failure, suspected fraud, delivery restrictions, or legal or regulatory issues.

If we cancel an order, any amount already paid will be refunded to the payment method used for the order.

6. Prices, Shipping Charges, Taxes, and Other Fees

Product prices are displayed on each product page. The product price, discount, and promotion in effect when an order is placed will apply to that order.

Shipping charges are displayed at checkout based on the destination country or region and the selected shipping method.

International orders may be subject to customs duties, import taxes, and other fees imposed by the destination country or region. Unless explicitly shown at checkout, these charges are not included in the product price or shipping fee and are the responsibility of the customer.

Product prices, discounts, promotions, and shipping charges may change without notice. However, an order that has already been accepted will normally remain subject to the conditions in effect when the order was accepted.

7. Payment

Available payment methods are displayed at checkout. You agree to provide accurate and valid payment information and confirm that you are authorized to use the selected payment method.

Payment is charged when the order is placed. We may be unable to accept an order if authorization, authentication, or processing by the payment service provider is unsuccessful.

8. Pre-Order Products

The full purchase price for a pre-order product is charged when the order is placed. The estimated shipping date or period is stated on the applicable product page.

The estimated shipping date may change due to production, availability, customs clearance, transportation, or other circumstances. If there is a material change, we will make reasonable efforts to notify you.

9. Shipping and Delivery

Available shipping methods, shipping charges, and estimated delivery times are displayed at checkout and described in our Shipping Policy. Delivery times are estimates and are not guaranteed arrival dates.

Delivery may be delayed due to carriers, customs clearance, weather, natural disasters, social or political events, an incorrect delivery address, or other circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address. If reshipping is required because the address you provided was incorrect or incomplete, you may be responsible for the additional shipping charges.

10. Cancellations, Returns, Exchanges, and Refunds

Our Cancellation Policy applies to order cancellations and changes. Our Refund Policy applies to product returns, exchanges, and refunds.

Due to the nature of food products and food-related utensils, we do not accept returns, exchanges, or refunds for reasons of customer preference. However, if a product is defective, damaged, contaminated, deteriorated, or incorrectly delivered, we will respond in accordance with the applicable policies.

11. Prohibited Activities

When using the Services, you must not engage in any of the following activities:

• Violating applicable laws, public order, accepted standards of conduct, or these Terms
• Engaging in or encouraging criminal or fraudulent activity
• Providing false information
• Impersonating another person
• Infringing the rights, property, reputation, or privacy of another customer, our business, or a third party
• Interfering with the operation or security of the Services
• Attempting unauthorized access or transmitting viruses or other harmful code
• Copying, collecting, reproducing, republishing, or commercially exploiting information from the Services without our permission
• Purchasing unusually large quantities for unauthorized resale

The Services are provided using Shopify’s platform. However, the seller of products offered through the Services is Stillness Lab LLC, and the sales contract is formed between you and Stillness Lab LLC.

15. Disclaimer of Warranties

We are not responsible for loss or damage caused by circumstances for which we are not responsible.

These Terms and contracts relating to the Services are governed by the laws of Japan.

If a dispute arises in connection with these Terms or the Services, you and we will first attempt to resolve it through good-faith discussion. If the dispute cannot be resolved, the Oita District Court or Oita Summary Court will have agreed jurisdiction as the court of first instance.

Nothing in this section limits any mandatory consumer rights or protections available to you under the laws of your country or region of residence.
